4\. November 2026 7 min.

The German Drinking Water Ordinance (TrinkwV) applies whenever drinking water systems are planned, installed, refurbished, operated or assessed. It sets out the requirements for waterworks, public authorities and drinking water systems in buildings, and regulates limit values, monitoring, testing obligations, responsibilities and measures to be taken in the event of non-compliance.

In Germany, the Drinking Water Ordinance is the legal framework governing the planning, procurement and operation of a drinking water system. It transposes EU requirements into national law and provides the binding framework for technical solutions, materials, documentation and operators’ obligations.

#### Key points at a glance:

•    The German Drinking Water Ordinance transposes key provisions of the EU Drinking Water Directive into national law.
•    Limit values, testing and monitoring ensure hygiene and safety right up to the point of supply.
•    Responsibilities lie with water suppliers, operators, owners, public health authorities, testing laboratories and specialist companies.
•    Lead pipes and sections containing lead had to be replaced or decommissioned by 12 January 2026 at the latest.
•    Pipe systems should not only be technically dimensioned but also hygienically suitable, verifiably documented and professionally installed.

## Definition: What is the Drinking Water Ordinance?

The Drinking Water Ordinance is the key set of regulations governing water intended for human consumption in Germany. Its official title is the ‘Ordinance on the Quality of Water Intended for Human Consumption’. This refers to drinking water in the broadest sense, as defined in the German Water Act: water for drinking, cooking, personal hygiene, food preparation and other hygienic purposes.

The Drinking Water Ordinance (TrinkwV) sets out in detail the requirements applicable to drinking water, how tests are to be carried out, which limit values must be complied with, and what measures may be taken in the event of non-compliance. This establishes a clear technical responsibility for [drinking water suppliers](https://blog.aquatherm.de/en/drinking-water-supply-systems-planning-infrastructure). Water quality must not be considered in isolation at the point of discharge from the waterworks. It is crucial that water is also distributed within the pipework in such a way that it meets the requirements at the point of use.

The definition is deliberately broad. It combines health and safety, technical installations and organisational obligations. For this reason, the choice of materials for the pipework system, pipework routing, temperature control, prevention of stagnation, cleaning, maintenance and documentation are all essential factors in a holistic safety concept.

## From the EU Drinking Water Directive to the Drinking Water Ordinance (TrinkwV) in Germany

The EU Drinking Water Directive forms the European legal basis for requirements relating to water intended for human consumption. The current Directive (EU) 2020/2184 was adopted on 16 December 2020 and sets out minimum requirements for drinking water in the European Union. In Germany, the Drinking Water Ordinance is the national implementation of European requirements. It incorporates technical rules and is therefore relevant to technical practice: legal requirements, generally accepted rules of technology, drinking water standards, material assessment and system documentation are all interlinked.

In 2023, the Drinking Water Ordinance was revised. It came into force on 24 June 2023. Among other things, this involves new quality parameters, lower limit values for individual substances, information requirements and risk-based drinking water protection. The Federal Environment Agency cites, amongst other key changes, the replacement of old lead pipes and lower limit values for chromium, arsenic and lead.

The risk-based approach of the amended Drinking Water Ordinance means that risks along the supply chain – from treatment through distribution to installation – are identified, assessed and managed at an earlier stage. For technical installations, this means that documentation, responsibilities and material information must be available in such a way that they can be reliably utilised in planning, operation and assessment.

## Who is affected by the Drinking Water Ordinance?

The Drinking Water Ordinance (TrinkwV) distinguishes between different water supply systems and areas of responsibility. The parties involved include water supply companies, operators or owners of water supply systems, building owners, public health authorities, authorised testing laboratories and specialist firms.

| **Stakeholder** | **Role in relation to the Drinking Water Ordinance** |
| --- | --- |
| **Water supply companies** | Provision and monitoring of the supply up to the respective area of responsibility |
| **Operator/owner** | Responsibility for the operation, testing, maintenance and documentation of the system |
| **Building owners** | Responsibility for the drinking water installation within the building, particularly in the case of letting, commercial or public use, as well as during refurbishment and for providing evidence |
| **Public Health Authority** | Monitoring, assessment of non-conformities and potential orders |
| **Testing laboratories** | Sampling, analysis and reporting of results in accordance with the requirements of the Regulation |
| **Specialist contractors** | Planning, installation, refurbishment and technical implementation in accordance with recognised standards |

The Regulation applies equally to central water supply systems and to building water supply systems that fall within the scope of the Drinking Water Ordinance (TrinkwV), e.g. in the case of the commercial or public supply of drinking water. It is therefore crucial for [drinking water hygiene](https://blog.aquatherm.de/en/driniking-water-hygiene-what-matters-in-building-installations) to establish where responsibility begins, where it is transferred and how it is documented.

The Public Health Authority is not merely a reporting body. It monitors and assesses test results and can order measures to be taken if requirements are not met. This interface is important for technical decisions because test reports, inventory data, material certificates and remediation measures must be collated in a way that allows for full traceability.

## Correctly interpreting the limit values in the Drinking Water Ordinance

Limit values have been established to set out the binding provisions of the Drinking Water Ordinance regarding monitoring, measures and responsibilities. A limit value describes the point at which a technical assessment, investigation of the causes and, where necessary, measures become required. The Federal Ministry of Health (BMG) points out that exceeding limit values does not automatically constitute a health risk in every case; the decisive factors are the extent and duration of the exceedance.

- **Parameters under the Drinking Water Ordinance:** The Drinking Water Ordinance (TrinkwV) sets out microbiological, chemical and radiological parameters, as well as indicator parameters; the associated limit values, requirements and parameter values are regulated differently depending on the parameter group. Examples include lead, chromium, arsenic, PFAS, bisphenol A, microcystin-LR, chlorate and chlorite. This selection is not an exhaustive list, but it illustrates the breadth of the Ordinance’s protective approach. For [drinking water quality](https://blog.aquatherm.de/en-gb/drinking-water-hygiene-what-matters), this means that limit values must be considered within the context of the system, usage, materials, temperature, stagnation and maintenance.
- **The lead issue:** Lead remains a practical concern. Under Section 17(1) of the Drinking Water Ordinance (TrinkwV), old lead pipes and sections containing lead were, in principle, required to be replaced or decommissioned by 12 January 2026. Since the expiry of this deadline, existing lead pipes – unless a permissible extension of the deadline applies – are subject to testing, documentation and remediation. Where lead pipes have not been removed or decommissioned, this may result in regulatory action, documentation requirements and administrative measures.
- **PFAS assessments:** PFAS are also now taken into account in the Drinking Water Ordinance. This refers to a group of highly persistent industrial chemicals that can enter the environment – and therefore also water bodies – via various routes. The Regulation introduces tiered requirements for this, including a limit value for the sum of 20 selected PFAS compounds that applies from 12 January 2026. For operators and those responsible, this means that PFAS will become an integral part of regulatory monitoring. They must be given greater consideration during the analysis, assessment and, where necessary, treatment of drinking water.

## Monitoring, testing and public health authorities

In addition to the limit values, the Drinking Water Ordinance also sets out the regulations governing monitoring, testing, testing obligations, testing bodies and the handling of non-compliance. In this way, the Drinking Water Ordinance links laboratory findings, technical installations and regulatory enforcement.

A distinction must be made between three situations:

1. **Regular monitoring:** Inspections carried out in accordance with a defined scope and at set intervals, depending on the installation and its use.
2. **Ad hoc inspections:** Checks carried out in the event of anomalies, alterations, refurbishments, changes in use or suspected non-compliance.
3. **Action in the event of exceedances:** Investigation of the causes, assessment by the public health authority and, where necessary, technical, organisational or operational measures.

The obligations and requirements regarding [Legionella in drinking water](https://blog.aquatherm.de/en-gb/legionella-in-drinking-water-responsibilities-prevention) serve as a prime example of how closely drinking water hygiene, hot water production, usage and testing obligations are interlinked. The Federal Ministry of Health (BMG) sets out testing obligations for water supply systems equipped with drinking water heating systems where drinking water is supplied, for example, as part of public or commercial activities.

This preventive approach applies to standard parameters such as Legionella or heavy metals, and it also encompasses specific detection requirements, such as compliance with the reference dose for radiological parameters.

## Selecting pipework systems in accordance with the Drinking Water Ordinance (TrinkwV): materials, verification and documentation

Pipes, fittings and seals come into contact with drinking water. They must therefore be suitable for this application. The Drinking Water Ordinance must be considered in conjunction with technical regulations, hygiene requirements, material assessments and standards. The DVGW (German Technical and Scientific Association for Gas and Water) clearly summarises the principle: materials in contact with drinking water must be safe in terms of their composition and manufacture so that they do not impair drinking water quality.

The key criteria for selecting pipework systems therefore include:

- Hygienic suitability and material assessment
- Approvals, certificates and technical documentation
- Temperature and pressure ranges
- Installation guidelines and joining techniques
- Storage, transport and site conditions
- Subsequent documentation for operation, maintenance or refurbishment

A pipework system forms part of a technical installation. Therefore, system components, installation, verification and subsequent documentation should all be consistent. For pipework design, this means that, in addition to pipe sizing and route planning, it is also crucial that the chosen system solution can subsequently be operated, inspected and assessed in a verifiable manner.

### aquatherm green as an exemplary solution

When it comes to material selection, there is a significant difference between metallic and PP-R pipework systems. Steel and copper are established materials, but their suitability always depends on water quality, operating conditions and corrosion behaviour. PP-R systems such as [aquatherm green](https://www.aquatherm.de/en-gb/solutions-products/products/aquatherm-green/) offer clear advantages here: the material is corrosion-resistant and odourless and tasteless. For drinking water installations, this results in a system solution suitable for a range of drinking water qualities, as aquatherm green meets the requirements for sanitary applications in accordance with ISO 10508, as well as technical specifications and regulations for planning, installation and hygiene.

Other benefits for planning and installation include the low pipe surface roughness, thermal and acoustic insulation properties, and a lower weight than steel or copper, making handling on site easier. The joining technology is also an integral part of the system. With PP welding processes, the pipe and fitting are joined together with a material-to-material bond. This enables leak-proof installations. In addition to the material advantages, the pipework system is characterised by a number of other factors. These include, amongst others, technical system information, EPDs, certifications, installation guidelines, tender documents, planning aids, BIM and services such as aquatherm’s prefabrication.

## Conclusion: The Drinking Water Ordinance as a guide for safe decisions

The Drinking Water Ordinance introduces a new perspective: moving away from pure water analysis towards a view of the entire system. This fundamentally changes the planning process. New questions must be taken into account. Which materials come into contact with drinking water? How is the installation operated? What evidence is available if values deviate or the public health authority requests documentation?

The implication for pipework systems is this: they are no longer simply a procurement item. Materials, connection technology, installation and documentation all influence how safely a drinking water installation can be operated, inspected and assessed over the years. During refurbishments, changes of operator or in the event of unusual test results, it becomes apparent whether technical decisions are sustainable in the long term.

The Drinking Water Ordinance (TrinkwV) should therefore be incorporated at an early stage into the specifications, tender documents and technical assessment. The more clearly material certifications, system information and installation specifications are documented, the less scope for interpretation there will be later during operation. This is precisely where its practical value lies: it compels us to view drinking water hygiene as a responsibility of both planners and operators.
